Terms of Service
These terms are an agreement between you and Overgear Studio (“we”, “us”) about your use of Kotodama Quest, a game for learning Japanese (the “game”). By playing, you agree to them. If you don't agree, please don't use the game. Our Privacy Policy explains how we handle your information.
1. Who can play
You must be at least 13 years old, or the minimum age in your country if that is higher, to use the game. If you're under the age of majority where you live, a parent or guardian must agree to these terms for you.
2. Your account
- You can play as a guest, with progress stored only on your device, or sign in so your progress is saved to your account and you can join raids and the leaderboard.
- You're responsible for activity on your account and for keeping access to your email or Apple ID secure.
- You can delete your account at any time from Profile → Account → Delete account.
3. The monthly pass
- The phone app requires a pass, sold through the App Store or Google Play, or, where the stores allow it, on our website through Stripe. On our website it's monthly or yearly. The price is shown before you buy.
- It renews automatically at the end of each month or year and you're charged unless you cancel at least 24 hours before the end of the current period. Cancel a store pass in your App Store or Google Play subscription settings, and a pass bought on our website with Manage subscription in the app (or by writing to us). Deleting the app doesn't cancel any pass; deleting your account cancels a pass bought on our website, but not a store pass.
- If a free trial is offered, any unused part of it ends when you buy a pass.
- For store purchases, payments, refunds and billing questions are handled by Apple or Google under their terms; we can't issue refunds for them ourselves. For a pass bought on our website, write to us at developer@overgearstudio.com with billing questions or refund requests.
- We may change the price of the pass. You'll be told in advance as the store requires, and a new price applies only from your next renewal.
4. Playing fairly
Raids and the leaderboard are shared with other players. You agree not to:
- harass, threaten or abuse other players, or write anything hateful, sexual, violent or illegal in raids or in your traveller name;
- share other people's personal information;
- edit saves, use bots or exploit bugs to change your level or leaderboard place;
- try to access other players' accounts or data, overload our servers, or get around the monthly pass;
- copy, resell or redistribute the game or its content, except as the law allows.
We may remove content, reset progress, or suspend or close accounts that break these rules.
5. What you write
You keep ownership of the lines you write in raids. You give us a worldwide, non-exclusive, royalty-free licence to store and show them to other players in the game for as long as the raid exists, including after you delete your account (shown without your name). You're responsible for what you write.
6. Virtual items
Coins, loot, items and levels in the game have no real-world value and can't be exchanged for money. They're part of the game, licensed to you for use in it, and may change as the game changes.
7. Our content and others'
- The game, its artwork, characters, code and text belong to us or our licensors. We give you a personal, non-transferable licence to use the game on devices you own or control, under these terms and the rules of the store you got it from.
- Kana stroke data comes from KanjiVG by Ulrich Apel, used under the Creative Commons Attribution-Share Alike 3.0 licence. Voice credits are shown in Profile → Audio.
- The game is not affiliated with or endorsed by the Japan Foundation or Japan Educational Exchanges and Services, which administer the Japanese-Language Proficiency Test (JLPT).
8. Learning, not a guarantee
The game is a study aid. We work to keep its words, readings and grammar accurate, but mistakes can happen, and we don't promise that using it will help you pass any test.
9. Changes and availability
We may update, change or stop parts of the game, including online features like raids and the leaderboard. The game may sometimes be unavailable, for example during maintenance. If we stop offering the game altogether, we'll give reasonable notice where we can.
10. Disclaimers
To the extent the law allows, the game is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. Some places don't allow these exclusions, so they may not apply to you, and nothing here affects rights you have as a consumer that can't be waived.
11. Limitation of liability
To the extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for lost data or progress, arising from your use of the game. Our total liability for any claim relating to the game is limited to the amount you paid us for it in the 12 months before the claim, or US$50 if that is more.
12. Ending this agreement
You can stop playing and delete your account at any time. We may suspend or end your access if you break these terms. Sections 5 to 13 continue to apply after this agreement ends.
13. Governing law
These terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law rules. Disputes will be handled in the courts of Muskegon, Michigan, unless the law where you live gives you the right to bring them elsewhere.
14. App Store
If you got the game from Apple's App Store: these terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the game, and isn't responsible for claims relating to it, including product liability, legal compliance or intellectual property claims. If the game fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. You confirm that you're not located in a country subject to a US government embargo and are not on any US government list of prohibited parties.
15. Changes to these terms
We may update these terms. We'll change the date at the top, and tell you in the game before significant changes take effect. If you keep playing after that, the new terms apply.
